1.About these terms

1.1These terms and conditions (the “Terms”) apply to your use of Home Bird, including the website at myhomebird.com, the Home Bird dashboard, shared sale packs and logbooks, and any emails we send (together, the “Service”).

1.2Home Bird is operated by [Company legal name], a company registered in England and Wales under company number [number], with its registered office at [registered address] (“Home Bird”, “we”, “us”). You can contact us at hello@myhomebird.com.

1.3By creating an account or using the Service you agree to these Terms. If you do not agree, please do not use the Service. Please read them alongside our Privacy Policy, which explains how we use your personal data.

2.What Home Bird is — and isn’t

2.1Home Bird is an organising tool. It helps you keep a record of your home’s running costs, insurance policies, documents, service history, meter readings, guarantees and property details, and to share a read-only sale pack or hand the record over to a new owner.

2.2Home Bird is not a financial, legal, surveying, conveyancing, insurance or energy adviser. Nothing in the Service is advice. Totals, reminders, readiness scores and suggestions are for your convenience only. Always check important matters with a qualified professional.

2.3Home Bird does not make payments to your providers, check whether bills have been paid, or renew, cancel or switch any policy or contract on your behalf.

3.Sale packs and the new sales pack rules

3.1The UK government has announced plans for sellers to provide upfront information when selling a home. At the date of these Terms, the final legal requirements have not been published or brought into force. Our sale pack features are designed to help you be ready, and we will update them as the rules develop, but we do not promise that a Home Bird sale pack will satisfy any particular legal, lender, agent or conveyancing requirement.

3.2You are solely responsible for the accuracy and completeness of the information you put in a sale pack and share with buyers, agents or solicitors. Sellers can be legally liable for giving incorrect or misleading property information. A Home Bird sale pack does not replace the property information forms, searches or advice provided through your conveyancer.

4.Your account

4.1You must be at least 18 and resident in the United Kingdom to create an account. You must give accurate information and keep your login details secure. You are responsible for everything that happens under your account unless it results from our failure to keep the Service secure.

4.2Tell us straight away at hello@myhomebird.com if you think someone else has accessed your account.

4.3Each membership covers one home. You should only add a home that you own, rent or are otherwise entitled to keep records about.

5.Free trial

5.1New accounts get a 14-day free trial with full access. No payment card is needed to start a trial, and you will not be charged automatically when it ends.

5.2When the trial ends, you can keep viewing what you have added, but you will need a paid membership to add, change or delete records or to email a sale pack. We do not delete your information because a trial has ended.

5.3We may change or withdraw the free trial offer for new customers at any time. Changes will not affect a trial that has already started.

6.Membership, prices and payment

6.1Membership costs £19.99 per year or £2.99 per month, per home, unless a different price is shown to you at checkout. Prices include VAT where it applies.

6.2Payments are processed by our reseller and Merchant of Record, Paddle.com Market Ltd (“Paddle”), who sells the membership to you on our behalf and handles payment, sales tax and billing. Paddle’s buyer terms also apply to your purchase. Your bank statement may show Paddle as well as Home Bird.

6.3Memberships renew automatically at the end of each monthly or yearly period, at the then-current price, until you cancel. You authorise the renewal payment to be taken from your chosen payment method.

6.4If you switch between monthly and yearly, the change takes effect straight away and any unused time on your current plan is credited proportionately against the new one.

6.5If we change the price, we will tell you by email at least 30 days before it applies to your next renewal. If you do not want to pay the new price, you can cancel before the renewal date.

6.6If a payment fails, we or Paddle may retry it. If it still cannot be taken, your membership may lapse and your account will return to view-only access.

7.Cancelling and refunds

7.1You can cancel at any time from Manage billing in your dashboard. Your membership then stays active until the end of the period you have already paid for, and will not renew.

7.2Your legal right to cancel: under the Consumer Contracts Regulations 2013 you can cancel a new paid membership within 14 days of the day you first pay for it and receive a refund. Because the Service starts immediately at your request, we may deduct a proportionate amount for the time you used before cancelling. To cancel within this period, use Manage billing or email hello@myhomebird.com.

7.3Outside the 14-day period, payments are not refundable except where required by law or where we have failed to provide the Service as described.

7.4Refunds are made by Paddle to your original payment method, normally within 14 days.

8.Your information and files

8.1Everything you add — bills, policies, service records, documents, invoices, photos, meter readings and property details (“Your Content”) — remains yours. You give us permission to store, process, display and back up Your Content only so far as we need to run the Service for you, including producing exports and the sale packs and logbooks you choose to share.

8.2You confirm you have the right to upload Your Content and that it does not infringe anyone else’s rights or contain unlawful material.

8.3Bills marked Personal are visible only to you and are never included in a shared sale pack or handed over with the home. Home running costs, service records, documents and property details belong to the home record and may be shared or handed over when you choose.

8.4You can export your outgoings and service record at any time. Please keep your own copies of important original documents; Home Bird is not a substitute for statutory record-keeping or document retention.

9.Sharing and handing over your home

9.1When you turn on sharing, anyone with the link can view the read-only sale pack or logbook. You decide who to give the link to, and you can turn sharing off at any time. We are not responsible for what others do with information you choose to share.

9.2When you hand over a home, ownership of the home record (excluding Personal bills) moves to the recipient once they accept using the email address you entered. After handover you will no longer be able to see or change that home record. Handover cannot be reversed by us except where we are legally required to.

10.Information from other sources

10.1Some features use information from third parties, such as company names and logos, Energy Performance Certificate data, postcode and address lookups, and council tax band links. We do not control these sources and cannot guarantee they are accurate, complete or always available. Company names and logos belong to their owners and are shown only to help you recognise your providers; their display does not imply any endorsement or partnership.

10.2Links to other websites, including gov.uk, are provided for convenience. We are not responsible for their content.

11.Acceptable use

11.1You must not: use the Service for anything unlawful, fraudulent or misleading; upload malware or try to break, overload or get around the Service’s security or membership limits; access another person’s account or data; copy, resell or scrape the Service; or upload content that is abusive, defamatory, infringing or that you do not have the right to share.

11.2Logo suggestions you submit may be reviewed and, if approved, shown to other users. You give us a free, permanent licence to use an approved logo suggestion for that purpose and confirm you are entitled to submit it.

12.Availability and changes to the Service

12.1We work hard to keep Home Bird available and secure, but we cannot promise it will always be uninterrupted or error-free. We may need to suspend it for maintenance, security or reasons outside our control.

12.2We may improve, change or remove features. If we make a change that significantly reduces what you have paid for, we will tell you in advance and you may cancel and receive a proportionate refund of any prepaid period you have not used.

12.3Reminder emails are a convenience. Please do not rely on them as your only way of meeting renewal, servicing, certificate or legal deadlines.

13.Our responsibility to you

13.1If you are a consumer, you have legal rights under the Consumer Rights Act 2015, including that digital services are provided with reasonable care and skill. Nothing in these Terms affects those rights. Citizens Advice can tell you more.

13.2We do not exclude or limit our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be excluded or limited by law.

13.3We are responsible for loss or damage you suffer that is a foreseeable result of our breaking these Terms or failing to use reasonable care and skill. We are not responsible for loss that is not foreseeable, for business losses (the Service is for domestic and private use), or for losses caused by your own information being inaccurate, by your decisions based on totals, reminders or readiness scores, by events outside our reasonable control, or by your failure to keep your login secure.

13.4Subject to the above, our total liability to you in any 12-month period is limited to the greater of the amount you paid us in that period and £100.

14.Closing your account

14.1You can stop using the Service and ask us to delete your account at any time by emailing hello@myhomebird.com. Please export anything you want to keep first; deletion is permanent, though backup copies may persist for a short period before being overwritten.

14.2We may suspend or close your account if you seriously or repeatedly break these Terms, if we are required to by law, or if we stop providing the Service. Unless there is an urgent reason, we will give you reasonable notice and a chance to export Your Content, and refund any prepaid period you have not used where the closure is not due to your breach.

15.Changes to these Terms

15.1We may update these Terms to reflect changes in the law, in the Service or in how we operate. We will tell you about significant changes by email or in the dashboard at least 30 days before they take effect. If you do not agree, you can cancel before they apply. The date at the top shows when these Terms were last updated.

16.Complaints and the law

16.1If something goes wrong, please email hello@myhomebird.com and we will aim to respond within 5 working days. Billing questions can also be raised with Paddle.

16.2These Terms are governed by the law of England and Wales. You can bring proceedings in the courts of England and Wales, or, if you live in Scotland or Northern Ireland, in the courts where you live.

16.3If any part of these Terms is found to be unenforceable, the rest remains in effect. You may not transfer your rights under these Terms without our consent; we may transfer ours to another organisation if this does not reduce your rights. No one else has any rights under these Terms.
